Under general supervision, performs legal work of a routine to complex nature in representing the County in prosecuting criminal and civil offenders; performs related work as assigned.
 
DISTINGUISHING CHARACTERISTICS
 
This is a multi-level class in which incumbents may be assigned to any of four levels, depending upon experience, proficiency gained, and the complexity and sensitivity of assigned cases. The work may be related to prosecuting cases in any of a number of legal specialty areas. Involvement in formal litigation, discretionary powers, and direction of the work of other professional staff increase as incumbents progress through the various levels. Deputy District Attorney IV is considered to be the highest level non-supervisory class, fully capable of working independently in any number of complex areas and providing direction and training to less experienced staff. While expertise may be gained in a specialized area, incumbents may direct or assist with the prosecution of cases from pretrial through appeal stages. These classes are distinguished from Assistant District Attorney in that the latter is a full supervisory class with responsibility for major areas of County prosecution activities and may act as the District Attorney on a relief basis.

 

EXAMPLES OF DUTIES

 

  •  Evaluates incoming complaints involving juvenile and adult offenders, family support issues, etc; recommends cases to prosecution, negotiate or dismiss.
  •  Interviews witnesses and victims of civil and criminal activities; reviews and analyzes evidence, police and other agency reports and other materials related to pending cases.
  • Provides direction to law enforcement and investigative personnel related to investigation of criminal offenses; provides advice as to applicable laws, court decisions and legal authorities.
  • Negotiates with defense counsel at pretrial hearings regarding case disposition or modification.
  •  Reviews, analyzes and researches allegations; makes determination as to appropriate charges following receipt of agency reports; files criminal charges; keeps victims and witnesses informed of the status of legal proceedings.
  •  Assists and advises District Attorney investigators and law enforcement agencies regarding investigations in process.
  •  Researches law and precedents to obtain information needed to prosecute and/or mediate pending cases; maintains current knowledge of changing case law.
  •  Manages court calendars to ensure that cases are resolved quickly; prepares for weekly settlement conferences; conducts in-chambers discussions with court and defense attorneys to facilitate case settlement.
  •  Performs trial work including jury selection, examination and cross-examination and argument of the prosecution case.
  •  Maintains accurate records and files and compiles reports of work performed.
  • Monitors legal developments, including proposed legislation and court decisions; evaluates their impact on the prosecution of civil and criminal cases and recommends appropriate action.
  •  Directs the work of professional and support staff as assigned.

CalPERS RETIREMENT PROGRAM

Employees fall into one of the following tiers based on the date you first start working for the County or any other employer that uses CalPERS for retirement.

  • Tier I - Prior to 7/5/2012: 2.7% @ 55
  • Tier II - Post 7/6/2012: 2% @ 55
  • Tier III - Post 1/1/2013: 2% @ 62

If this is your first job with a CalPERS employer, you’d be in Tier III.

  • 2.0 means that for every year you work for the County, you will receive 2% of your maximum annual pay rate for every year that you work for us (or other CalPERS employers) if you work the required minimum number of years (that’s called vesting) and retire after the age following the @.
  • If you work 20 years and retire at 62 years of age, you will receive 20 x 2% or 40% of your maximum annual pay rate every year in retirement payments.

The Sixth District Appellate Program is looking to hire two new staff attorneys with start dates in July. SDAP contracts with the state to provide administrative services to the Sixth District Court of Appeal and to assist court-appointed counsel in felony, delinquency, dependency, and mental health appeals.

Duties of a staff attorney include directly representing clients in appeals, assisting panel attorneys, and training appellate and trial attorneys. The staff attorney also evaluates the work of panel attorneys and reviews their claims for compensation in appointed cases. Minimum qualification includes active California Bar membership and experience in criminal or appellate practice.

The County Counsel’s Office serves as the civil attorneys for Tulare County government, the Tulare County Association of Governments, the Tulare Local Agency Formation Commission, and the Workforce Investment Board.  The Legal Office includes 25 Attorneys, plus a compliment of paralegals and support staff. The office is located in the City of Visalia at the County Civic Center. Typical Duties

CAREER OPPORTUNITY:

While the successful candidate may be able to work with or on any of the five legal teams at County Counsel, the current vacancy being filled is on the Resource Team. The successful candidate will be expected to review contracts, advise clients on various general law related matters, assist the County’s Resource Management Agency and General Services Agency in various public works, capital construction projects, eminent domain, public debt and/or public finance, and land use planning law matters, and provide legal guidance to various public agency boards and committees. Previous experience in a County Counsel’s or City Attorney’s Office, or other public agency’s legal department is highly desirable.

Employment Standards

EXPERIENCE:

Active membership in the State Bar of California is required. Possession of, or ability to obtain, a valid California driver's license is required. Newly hired Attorneys will serve At-Will and hold non-competitive status. The Position
The current vacancies are in Ukiah and Fort Bragg, CA. 
The list developed from this recruitment will be used for a limited period to fill open and promotional, regular full-time, and part-time positions, should they occur. Pursuant to current bargaining unit agreement, employees regularly assigned to the coastal region including Fort Bragg, Mendocino, or in Point Arena, shall receive a 5% assignment premium. OFFICE OF CLIENTS’ RIGHTS ADVOCACY

DRC has a contract with the Department of Developmental Services (DDS), State of California, to provide Clients’ Rights Advocacy services for clients of each of the 21 regional centers located statewide. That contract funds the Assistant Clients’ Rights Advocate (ACRA) position. We are a team of zealous advocates and disability generalists who are building a culture of teamwork and working for a world where all disabled people have power, are treated with dignity and respect, and make their own decisions.

PURPOSE OF THE JOB

The ACRA assists and advocates for people with developmental disabilities who are regional center clients, including people who reside in state developmental centers and community facilities. The ACRA is primarily responsible for clerical and administrative support for the office, which provides information, advice, and representation on a wide range of legal topics impacting people who receive regional center services. Examples are special education, Social Security, IHSS, healthcare and insurance, and living in the community.

The ACRA works under the direct supervision of a clients’ rights advocate and in collaboration with other OCRA advocates and attorneys in their advocacy and outreach efforts.

This position is in a location convenient to the regional center and is eligible for a hybrid schedule working both remotely and in-office. Currently the office is located at 1831 K Street in Sacramento. The ACRA may work remotely up to three days per week.

JOB RESPONSIBILITIES

Essential functions are the job responsibilities an employee must be able to perform, with or without reasonable accommodation. ACRA essential functions include:

Support and Advocacy – 85%

  • Work in-person in DRC’s Sacramento office a minimum of two days per week, in collaboration with OCRA’s Alta California Regional Center team.
  • Greet callers and provide initial response to requests for help.

  • Process incoming and outgoing mail.
  • Apply screening guidelines to identify problems and determine appropriateness of advocacy services.

  • Strengthen and build relationships with local community-based organizations.

They represent OCRA in public and serve as a liaison to stakeholders such as clients, their families, and agencies and organizations such as DDS, Regional Centers, and the State Council on Developmental Disabilities. They lead multiple OCRA projects and program activities, ensuring that OCRA has the staff, resources, and tools to provide high quality advocacy services. The Associate Director is a thought partner and back-up to the OCRA Director and promotes a positive work environment and teambuilding within OCRA.

JOB RESPONSIBILITIES

Leadership

  • Provide leadership and strategic direction to OCRA staff, including supervision, workload management, training, and mentoring.
  • With the OCRA Director, lead initiatives that ensure skill development at all levels, including substantive legal topics, OCRA and DRC policies and procedures, and supervision, communication, and teambuilding.
  • Plan and participate in OCRA management team meetings; serve as backup to the OCRA Director when needed.
  • Represent OCRA with stakeholder organizations and collaborators.
  • Maintain effective working relationships with DDS, other government actors, other legal services programs, and disability constituency groups.
  • As needed, attend DRC Board meetings and report on OCRA work.
  • With the OCRA Director, oversee OCRA day-to-day operations and ensure compliance with contract requirements.
  • Provide technical assistance and substantive training in areas of expertise to OCRA staff.
  • Address systemic problems and issues related to OCRA and its clients by collaborating with clients, their families, and agencies and organizations such as DDS, Regional Centers, and the State Council on Developmental Disabilities.

Administration

  • Monitor approved budget and participate in preparation of required contract reporting.
  • Review and approve expenses consistent with program budget.
  • Conduct quality assurance reviews of required data and ensure accurate reporting of contract deliverables.
  • Interface with Information Technology on data collection and other topics in support of OCRA’s effective advocacy.
  • Assist with client grievances.
  • Evaluate data, prepare reports, and attend DRC board meetings to report on activities as needed.

Other Functions

  • Perform other duties as assigned.

SUPERVISORY RESPONSIBILITIES

Directly supervise OCRA staff as necessary to carry out program requirements consistent with DRC’s policies, applicable laws, and contract requirements, including but not limited to Managing Attorneys, Supervising Clients’ Rights Advocates, Supervising Attorneys, and Office Managers.

Responsibilities include interviewing, hiring, and training employees; planning, assigning, and directing direct work; regularly evaluating performance and providing ongoing feedback; working with Human Resources to take corrective actions when needed; addressing complaints and resolving problems; reviewing and approving timesheets, travel requests, and expense reimbursements within required timeframes.

MINIMUM QUALIFICATIONS

EDUCATION AND EXPERIENCE:

(Applicants MUST meet EACH of the minimum qualifications to be considered for an interview.)

  • Juris Doctor degree or equivalent and membership in the California State Bar.
  • At least ten years’ experience as a practicing attorney with at least four years of practice in public interest law. Judicial clerkships or externships may count as up to one year of legal practice experience.
  • At least five years’ experience advocating for the rights of people with disabilities or other underserved groups.
  • At least five years’ experience supervising multiple attorneys and/or advocates with demonstrated results reflecting successful mentoring and leadership.
  • Proven ability to supervise multiple staff while also accomplishing administrative responsibilities.
  • Experience with laws, rights, and services as they pertain to people with disabilities, or direct representation of people with disabilities.
  • Demonstrated ability to communicate effectively, including planning communication strategies and effective interpersonal and conflict resolution skills.
  • Demonstrated ability to work and supervise colleagues in a distributed and/or remote work environment.
  • Demonstrated ability to analyze complex problems and develop creative solutions.
  • Demonstrated commitment to diversity, equity, inclusion, and access and ability to work effectively with diverse groups of people.
  • Proficiency with Windows-based computer applications including Microsoft Office software, case management software, database applications, and videoconferencing software like Zoom and Microsoft Teams.
